Oregon's firearm statutes create specific gaps in protection for families dealing with volatile histories, a reality that has come into sharp focus following the tragedy at Silver Rail Elementary. A week after the mass shooting that claimed four lives, investigative records clarify how a 16-year-old student arrived at his former school with a loaded shotgun that belonged to his mother.

Shauntai Nickerson legally purchased a Mossberg Maverick 88 pump-action shotgun in August, registering the weapon in her name. Officials noted the firearm typically costs between $250 and $300, though they have not disclosed the specific retailer. Under current state law, parents or guardians may legally provide rifles and shotguns to teenagers aged 16 and 17, a provision that applied to this family dynamic.

The central legal question rests on the distinction between an accusation and a conviction. Oregon bars the sale of firearms to individuals convicted of violent misdemeanors, such as assault, within the preceding four years. Because Nickerson had no assault conviction on record at the time of purchase, the restriction did not trigger. Had she been found guilty in either of her 2023 cases, the purchase would have been illegal.

Records from a January 2023 police report describe an incident outside a Taco Bell where Nickerson and her daughter, Ariel Swan, assaulted a woman. The report states that Nickerson followed the victim in a white SUV and attempted to run her over before the two women exited the vehicle to attack. The pair claimed the victim had slept with Nickerson's ex-boyfriend, a claim the victim denied. Swan was charged with harassment and attempted fourth-degree assault, while Nickerson, who allegedly charged at officers, was neither arrested nor charged.

In a second incident less than two months later, Nickerson faced charges of assault and harassment involving a different woman. Court documents indicated she caused physical injury but lacked detailed police reports. She pleaded guilty to harassment in October 2023. Two weeks later, the Deschutes County District Attorney's office dismissed the assault charge, stating in a recent release that there was insufficient evidence to secure a conviction at trial.

Legal experts suggest this outcome was likely the result of a plea bargain. Tung Yin, a professor at Lewis & Clark Law School, explained that such agreements allow both sides to avoid the unpredictability and cost of a full trial. He emphasized that prosecutors and police have broad discretion in deciding which cases to pursue, noting that they must prioritize resources among many potential crimes.

Investigators have not yet established a clear motive, though local media reports suggest possible links to extremist groups. The shooter was killed by a parent during the incident. His background includes a complex family history, with his father, Griffin J. John, holding a felony conviction for assaulting a police officer and other misdemeanor charges. Nickerson was also a victim of domestic violence in 2014, a case that ended in a deferred sentencing program.

Experts in the field of school violence highlight the critical role of access. Dr. Harold Schwartz, a psychiatry professor at the University of Connecticut, stated that while many people share traits like isolation and anger, the availability of a weapon is the most significant differentiator. National data indicate that 77% of mass shooters legally accessed their firearms, and over 80% of school shooters took guns from family members. While some reports suggest the gun was a birthday gift, this detail remains unverified by the Oregon Journalism Project.

Nickerson, along with her ex-boyfriend Kyle Duncan and daughter Swan, did not return calls seeking comment on the events that led to the purchase and the subsequent tragedy.
