Ex-FBI Leaders Indicted Over Laptop Testimony
Two former intelligence officials face perjury charges for their 2023 congressional statements regarding the Hunter Biden computer.

Former FBI executives Nikki Floris and Bradley Benavides now face the prospect of five years in prison each for allegedly lying to Congress. The Justice Department filed charges on Friday, accusing the pair of concealing details about the bureau's handling of investigations tied to Hunter Biden. Both defendants appeared before a federal magistrate judge on Friday morning and were released on their own recognizance.
The legal action stems from testimony given to the House Judiciary Committee in 2023. According to an FBI affidavit, Floris, who led the intelligence division in the Washington field office, denied any involvement in the Hunter Biden probes. The document states she was in frequent communication with the case team for over a year. It further alleges she coordinated the FBI's real-time response to news coverage of the laptop while claiming she knew nothing about it. Benavides, a former deputy assistant director for counterintelligence, testified months later that he learned of the laptop via Wikipedia. The affidavit counters that he was in constant communication about the device over several days.
A committee member stated that these answers influenced the investigation's direction, specifically by hindering follow-up interviews and subpoenas. US Attorney Jeanine Pirro, whose office is prosecuting the case, said in a statement that the pair undermined the institutions they swore to uphold. She characterized their actions as believing they were above the law.
Defense attorneys for Floris rejected the allegations, arguing the charges were based on political assertions rather than facts. They described Floris as a patriot who served for nearly 20 years and noted the timing of the filing on the eve of an election. Ron Safer, representing Benavides, asked the court to review whether prosecutors had sufficient evidence against the two lifetime public servants.
US Magistrate Judge Zia M. Faruqui raised questions about the timing, noting the charges were filed more than three years after the testimony. He granted a request for an evidentiary hearing scheduled for Tuesday. Faruqui called the timing rare but acknowledged the defendants' strong backgrounds in law enforcement. He described the situation as a Sword of Damocles hanging over their heads.
The laptop at the center of the dispute was handed to the FBI in 2019 by a computer shop owner who said Hunter Biden dropped it off and never returned. The owner told the Washington Post he turned it over after viewing its contents. The device has remained a partisan flashpoint, with Republicans citing evidence of corruption and Democrats describing it as a conspiracy. The indictments arrive as many FBI agents accused of working against President Donald Trump have been pushed out of the bureau since the start of his second term.
